1. Introduction
These Terms & Conditions ("Terms") govern your access to and use of the services, software, and websites provided by Hoskins Travel LLC, doing business as Vencresa ("we," "us," or "our"), including the Vencresa platform and client portal (collectively, the "Service"). By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. Account Registration
You must provide accurate and complete information when registering for an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
3. Acceptable Use
You agree not to misuse the Service. Prohibited activities include, but are not limited to: (a) using the Service for any unlawful purpose; (b) uploading or transmitting viruses, malware, or other harmful code; (c) attempting to probe, scan, or test the vulnerability of the Service; (d) scraping or data mining the Service without authorization; (e) infringing intellectual property rights; (f) engaging in fraud, spam, or deceptive practices; and (g) interfering with the proper working of the Service.
4. Intellectual Property
Hoskins Travel LLC retains all rights, title, and interest in and to the Service, including all software, source code, object code, algorithms, workflows, prompts, scoring logic, data pipelines, user interfaces, designs, look-and-feel, branding, trademarks (including "Vencresa"™ and the Vencresa logo), trade dress, trade secrets, know-how, and all related intellectual property rights worldwide. We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service solely for your internal business purposes in accordance with your selected subscription plan. No other rights are granted by implication, estoppel, or otherwise.
You agree that you will not, and will not permit any third party to: (a) copy, modify, translate, or create derivative works of the Service or any portion of it; (b) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, underlying ideas, algorithms, or structure of the Service, except to the extent this restriction is prohibited by applicable law; (c) rent, lease, lend, sell, sublicense, assign, distribute, publish, or otherwise transfer the Service or access to it; (d) build a competitive product or service, or copy any features, functions, or graphics of the Service; (e) scrape, harvest, index, cache, or otherwise collect data from the Service by any automated or manual means; (f) remove, alter, or obscure any proprietary notices (including copyright and trademark notices) contained on or in the Service; or (g) use the Service to train, fine-tune, or evaluate any machine learning model without our express prior written consent. Any feedback, ideas, or suggestions you provide about the Service are assigned to us and may be used by us without restriction or compensation.
You retain ownership of Content you upload (client data, itineraries, media). You grant us a worldwide, royalty-free, non-exclusive license to host, store, process, transmit, display, and create derivative works of your Content solely to operate, maintain, secure, and improve the Service for you. Aggregated, de-identified usage data may be used by us to improve the Service and for analytics.
5. Payment and Subscriptions
Certain features of the Service require a paid subscription. All payments, billing, tax, cancellation, and refund mechanics are handled by our online reseller and Merchant of Record, Paddle.com. By subscribing, you agree to Paddle's Buyer Terms. Subscription fees are charged in advance on a monthly or annual basis, depending on the billing interval you select. Subscriptions automatically renew unless canceled before the next billing period.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. See §13 for how default affiliate, referral, and tracking links may be inserted across the Service when you have not configured your own.
6. Cancellation and Termination
You may cancel your subscription at any time through your billing settings or via Paddle's customer portal. If you cancel, your access will continue until the end of your current paid period, after which your account will be downgraded. We reserve the right to suspend or terminate your access immediately if you materially breach these Terms, engage in fraudulent or illegal activity, or create a security risk.
7. Service Level and Warranties
We strive to keep the Service available and secure, but we do not guarantee uninterrupted or error-free performance. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
8. Limitation of Liability
To the fullest extent permitted by law, Hoskins Travel LLC's aggregate liability arising out of or relating to these Terms or the Service shall not exceed the total amount you paid to us in the six (6) months preceding the event giving rise to the liability. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data.
9. User Content
You retain ownership of any data, contact information, trip details, or other content you upload to the Service ("User Content"). You grant us a limited license to host, process, and display your User Content solely as necessary to provide the Service to you. We do not use your User Content to train AI models or for any purpose other than operating the Service.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Idaho, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Idaho.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.
13. Default Affiliate, Referral & Tracking Links
The Service inserts third-party links, buttons, embeds, QR codes, and similar references to partners such as Viator, Amazon, hotel and tour suppliers, booking engines, and other experience or product providers. These references may appear anywhere in the Service, including but not limited to: outbound and transactional emails, SMS or other messaging, destination guides, trip intelligence, itineraries and proposals, the travel store and storefronts, the client portal, shared trip links, exported or printed documents (including PDFs), AI-generated recommendations, and any future advisor- or client-facing surface.
When you (the advisor or agency) have configured your own affiliate, referral, or tracking identifiers for a given partner in Settings, the Service will use your identifiers so that any resulting commission or credit is attributed to you.
When you have not configured an identifier for a partner, or your identifier is missing, invalid, expired, or rejected by the partner, you authorize Hoskins Travel LLC (d/b/a Vencresa) to insert its own default affiliate, referral, or tracking identifiers into those references, on any surface described above. This fallback is intended to preserve the traveler experience (working links, curated recommendations, accurate attribution) and may result in Hoskins Travel LLC and/or Vencresa earning a commission, referral fee, or other consideration on qualifying transactions. No commission is owed to you on transactions completed through these default identifiers, and Hoskins Travel LLC / Vencresa retains 100% of any such earnings.
You may eliminate the fallback for any partner at any time by adding your own credentials in Settings → Affiliates. You are responsible for ensuring your own affiliate participation complies with the applicable partner program terms (e.g., Amazon Associates, Viator Affiliate) and with FTC endorsement and disclosure rules for content you send or publish to clients.
13a. SMS Program Terms
Vencresa (operated by Hoskins Travel LLC) offers SMS text messaging to travelers and users who provide express written consent. By opting in, you agree to the following program terms:
- Program description: Transactional messages (booking confirmations, payment receipts, trip updates, itinerary changes, document requests, appointment reminders) and, if separately opted in, marketing or nurture messages from your travel advisor.
- How to opt in: By submitting a form on our website or a partner advisor's site with the SMS consent box checked, by texting START to a Vencresa-provisioned number, or by providing verbal or written consent recorded by your travel advisor.
- Message frequency: Recurring messages, up to 4 messages per month for marketing programs. Transactional trip messages you request (booking confirmations, itinerary or flight changes) are sent as those events occur.
- Message and data rates may apply. Check with your mobile carrier for details.
- Supported carriers: AT&T, Verizon Wireless, T-Mobile, Sprint, US Cellular, Boost, MetroPCS, Google Voice, and other major U.S. carriers. Carriers are not liable for delayed or undelivered messages.
- Opt-out: Reply STOP to any message to cancel. You will receive a one-time confirmation and no further messages will be sent unless you re-subscribe.

- Privacy: Mobile phone numbers and SMS consent data are never shared with third parties or affiliates for marketing purposes. See our Privacy Notice for full details.
